Hillary In Trouble: State Department Says Clinton Did Not Comply With Federal Record Policies: Full OIG Report

Tyler Durden's picture

http://www.zerohedge.com/news/2016-05-25/hillary-trouble-state-department-says-clinton-did-not-comply-federal-record-policies

In a surprising reversal, what many thought was impossible, namely the State Department cracking down on its former head and Democratic presidential frontrunner, Hillary Clinton, seems all too possible following news that the State Department Insecptor General audit has faulted Hillary Clinton, other secretaries of state for poorly managing electronic communications.
  • CLINTON'S FAILURE TO SURRENDER ALL EMAILS DEALING WITH DEPARTMENT BUSINESS BEFORE LEAVING GOVERNMENT VIOLATED POLICY -INSPECTOR GENERAL

As WaPo notes, which obtained the report in advance of its publication, the IG found that Clinton’s use of private email for public business was “not an appropriate method” of preserving documents and that her practices failed to comply with department policies meant to ensure that federal record laws are followed.
The report says Clinton, who is the Democatic presidential front-runner, should have printed and saved her emails during her four years in office or surrendered her work-related correspondence immediately upon stepping down in February 2013. Instead, Clinton provided those records in December 2014, nearly two years after leaving office.
The report found that a top Clinton aide was warned in 2010 that the system may not properly preserve records but dismissed those worries, indicating that the system passed legal muster. But the inspector general said it could not show evidence of a review by legal counsel.
As Politico adds, the State Department inspector general concluded that Hillary Clinton did not comply with the agency’s policies on records, according to a report released to lawmakers on Wednesday that also revealed that Clinton and her top aides chose not to cooperate with the review.
The agency on Wednesday released the long-awaited report to Capitol Hill, copy of which was obtained by POLITICO, providing just the latest turn in the headache-inducing saga that has dogged Clinton's campaign.
While the report concludes that the agency suffers from "longstanding, systemic weaknesses" with records that "go well beyond the tenure of any one Secretary of State,” it specifically dings Clinton for her exclusive use of private email.
“Therefore, Secretary Clinton should have preserved any Federal records she created and received on her personal account by printing and filing those records with the related files in the Office of the Secretary,” the report states. “At a minimum, Secretary Clinton should have surrendered all emails dealing with Department business before leaving government service and, because she did not do so, she did not comply with the Department’s policies that were implemented in accordance with the Federal Records Act."
The report states that its findings are based on interviews with current Secretary of State John Kerry and his predecessors – Madeleine Albright, Colin Powell and Condoleezza Rice, but that Clinton and her deputies declined the IG’s requests for interviews.
Cheryl Mills, Jake Sullivan, and Huma Abedin are among those who did not cooperate with the investigation.
The IG report is just one of many fronts that still exist in the email scandal. Clinton also faces an ongoing FBI investigation into the setup of the private server that she used for official State Department business during her four years in the Obama administration, and various Freedom of Information Act lawsuits are working their way through the courts.
Needless to say, the report will only provide more ammunition for Donald Trump, who has already been seizing on the persistent controversy, which first emerged in March of last year, as he tries to further undermine the trustworthiness of "Crooked Hillary," as he calls her.
Clinton and her allies contend she did nothing illegal by choosing to set up a private email server and account at her Chappaqua, New York, home, and that she was not trying to evade public records requests. Instead, Clinton has said she was motivated by the desire for convenience, though she has conceded it was not the best choice.
One again wonders if there is a quiet press behind the scenes to push for Bernie Sanders, or even Joe Biden at the Democrat convention if enough dirty laundry piles up against Hillary, who it is no secret has had a rocky relationship with many of the current Democrat power elite.
A quick observation from Glenn Greenwald who finds quick lie in the process:
Wow: 2 State staffers raised concerns re HRC's server: were told never to do so again b/c it was approved: false

The FBI Tried To Suppress 80,000 Documents On Saudi Ties To 9/11

Tyler Durden's picture

http://www.zerohedge.com/news/2016-05-17/fbi-tried-suppress-80000-documents-saudi-ties-911

Submitted by Carey Wedler via TheAntiMedia.org,
The classified 28-pages of the 9/11 report have made global headlines lately as a handful of lawmakers battle to release them to the public. Those pages are believed by activists and members of Congress — who have seen them — to expose the role of Saudi Arabia, including government officials, in the terrorist attacks.
But according to a new report based on years of investigative journalism, it turns out there are far more than 28 classified pages on Saudi Arabia and 9/11 — there are 80,000 kept secret by the FBI. And though not all 80,000 are expected to concern the Saudi family — and the FBI insists their investigation of the documents came up empty-handed — journalists, at least one lawmaker, and heavily-redacted documents suggest otherwise.
As the Daily Beast reported, the discovery of the 80,000 pages came when Irish investigative journalists Anthony Summers and Robbyn Swan were contacted by an unnamed counterterrorism official in 2011. The reporters were preparing to publish a book on the 10th anniversary of the terror attacks and were told  by the source that a Saudi family who had been living in Sarasota, Florida, prior to the attacks had connections to the attackers. Specifically, they were linked to Mohamed Atta, the Egyptian terrorist widely recognized as the ringleader of the attacks.
The unnamed official’s tip conflicted squarely with the FBI’s prior conclusions on that family. Abdulazzi al-Hiijjii, his wife Anoud, and their three small children lived in an upscale Sarasota community, along with Anoud’s father, Esam Ghazzawi, a financier and interior designer, who owned the home, and Ghazzawai’s American-born wife. The FBI had received multiple calls from the family’s neighbors expressing concerns over erratic behavior. Two weeks before 9/11, they left the house in a huge hurry, leaving dirty diapers and toys strewn about, a fully stocked refrigerator, and three cars in the driveway.
Though the FBI opened an investigation in April 2002, it still insists it never found any significant connection between the family and Atta. The agency acknowledged they had suspected a connection, but “not until after the Tampa field office opened an investigation that claimed to find ‘numerous connections’ between the family and the 9/11 hijackers,” the Daily Beast explained. The 80,000 classified pages in question stemmed from that investigation.
The FBI says “the bureau’s own agents did initially suspect the family was linked to some of the hijackers.” But “on further scrutiny, those connections proved unfounded, officials now say.”
But Summers and Swan contacted Dan Christensen, a veteran Florida reporter, and together they published an exposé on these connections in Sarasota in September 2011. As they reported, following the 9/11 attacks:
“[L]aw enforcement agents not only discovered the home was visited by vehicles used by the hijackers, but phone calls were linked between the home and those who carried out the death flights — including leader Mohamed Atta — in discoveries never before revealed to the public.”
They were also never revealed to lawmakers. The 2011 story caught the attention of Bob Graham, a Florida Democrat who has since led the campaign to release the 28 pages on the Saudi connection, which are said to contain information showing Saudi government officials were involved in orchestrating the attack.
At the time, he said the journalists had “open[ed] the door to a new chapter of investigation as to the depth of the Saudi role in 9/11.” Graham attempted to view some of the documents, and told the Daily Beast (for a forthcoming article) they did show a connection between the family and three hijackers. He was soon after confronted by then-deputy director of the FBI, Sean Joyce. According to Graham, he said, “Basically everything about 9/11 was known and I was wasting my time and I should get a life.”
Christensen filed a Freedom of Information Act request in the hopes of either confirming or refuting their original reporting. Thomas Julin, his lawyer, said the FBI initially denied having any records. When Graham said he was willing to testify he had seen some, the Department of Justice conveniently admitted to having 35 relevant pages. They released them, but they were heavily redacted. In spite of the overt censorship guarding that information, they reportedly still made clear the FBI had suspicions about the family — and that they had found several connections between them and the hijackers. The pages also include the FBI’s dismissals of those suspicions.
U.S. District Court Judge William Zloch, who presided over the Freedom of Information case, was unconvinced and demanded the FBI conduct another search of its records. This time,“the FBI found some additional responsive documents which it produced,” Juline told the Daily Beast. “But it also found 80,266 pages of material in the Tampa Field Office of the FBI which had been marked with the file number for the FBI’s PENTTBOM investigation.”
PENTTBOM was the FBI term for its investigation into the 9/11 attacks. Though the New York Post had previously reported on these 80,000 pages, the DoJ’s small release of documents clarified suspicions. Zloch ordered the FBI to hand over all the documents in May 2014 — and he is still going through them to determine which pages can be released. He has given no indication of when he will be finished.
The Daily Beast explained “Zloch’s task is made all the more painstaking by the strict security rules governing review of classified documents, even for a sitting judge. The files are kept in a secure facility, and he can only remove a portion at a time.”
It remains unclear how many of the 80,000 pages pertain directly to the Tampa FBI field office’s investigation of the family in Sarasota — and their ties to the attackers. Though Christensen says he’s ready to be proven wrong, he believes “those files will reveal the underlying reasons for the FBI’s early suspicions.”
As the Daily Beast laid out:
“The FBI, for instance, says that phone records searches showed no links to the house and the hijackers. Christensen’s confidential source says the opposite is true. If the FBI is right, Christensen asks, then why not just release the information and put the dispute to rest?”
The FBI has attempted to discredit the pages, claiming the agent who filed the first reports on the family and their potential connection to the hijackers was “not a good writer and should not be taken as the last word,” according to Graham. However, that agent was promoted shortly after 9/11, casting doubt on assertions they were incompetent.
In a similar evasion of accountability, President Obama vowed to block a legislative effort to release the 28 pages amid pressure from the Saudi Arabian government, which threatened to remove $750 billion in American assets should the legislation pass. The president cited concerns that allowing families of 9/11 victims to sue a foreign government could, in turn, open the United States government up to prosecution, itself. The White House has since indicated it intends to release part of the 28 pages.
Though Julin says the 28 pages likely aren’t linked to the Sarasota Saudi family, he hopes their eventual release “might help Judge Zloch see the wider significance of the events in Sarasota and persuade him that some or all of the records have not been properly classified.”
Last week, a former member of the 9/11 commission said he believes six Saudi officials supported the 9/11 hijackers. John F. Lehman said Wednesday, “There was an awful lot of participation by Saudi individuals in supporting the hijackers, and some of those people worked in the Saudi government,” he said. “Our report should never have been read as an exoneration of Saudi Arabia.”
The FBI’s trove of documents also requires further examination. Julin dismissed suspicions Judge Zloch is intentionally lagging in his investigation of the 80,000 pages. “I believe this is not a stalling tactic at all,” he said. “The judge is doing what he has to comply” with the stringent rules surrounding the release of the classified documents. “But I would urge him to speed it up,” he said.

Notorious Hacker Makes 'Bombshell' Claim: "I Got Inside Hillary's Completely Unsecured Server"

Tyler Durden's picture

Guccifer
In a dramatic development that could lead to renewed focus on Hillary Clinton's email server scandal, NBC reports that the Romanian hacker who first exposed Hillary Clinton's private email address is making a "bombshell" new claim: that he also gained access to the former Secretary of State's "completely unsecured" server.
"It was like an open orchid on the Internet," Marcel Lehel Lazar, who is better known by his handle Guccifer which he used when he first unveiled the formerly unknown domain name of Hillary personal server one year ago, told NBC News in an exclusive interview from a prison in Bucharest. "There were hundreds of folders."

Cynthia McFadden, right, with the Romanian hacker Guccifer in Romania
As previously reported, Lazar was extradited last month from Romania to the United States to face charges he hacked political elites, including Gen. Colin Powell, a member of the Bush family, and former Clinton advisor Sidney Blumenthal.
NBC further reports that according to a source with knowledge of the probe into Clinton's email setup told NBC News that with Guccifer in U.S. custody, investigators fully intend to question him about her server.
To this point Lazar, 44, has not provided documentation to back up his claims, nor has he released anything on-line supporting his allegations, as he had frequently done with past hacks. The FBI's review of the Clinton server logs showed no sign of hacking, according to a source familiar with the case.
Brian Fallon, national press secretary for Clinton's presidential campaign, said Guccifer's claims were baseless. "There is absolutely no basis to believe the claims made by this criminal from his prison cell," said Fallon. "In addition to the fact that he offers no proof to support his claims, his descriptions of Secretary Clinton's server are inaccurate. It is unfathomable that he would have gained access to her emails and not leaked them the way he did to his other victims.
"We have received no indication from any government agency to support these claims, nor are they reflected in the range of charges that Guccifer already faces and that prompted his extradition in the first place," Fallon added. "And it has been reported that security logs from Secretary Clinton's email server do not show any evidence of foreign hacking."
That strawman, of course, now puts Hillary in harms way as it redoubles attention on a scandal that many had decided was likely going to blow over. All that Trump will have to do now is find confirmation that Lazar is telling the truth and suddenly Clinton's email transgressions will get a renewed lease on life at the worst possible moment, just as a federal judge opened the door to interviewing Hillary Clinton as part of a review into her use of a private email server while secretary of State.
All this is happening just as as Hillary thought she had managed to put her email scandals behind her.
According to The Hill, Judge Emmet Sullivan of the U.S. District Court for the District of Columbia laid out the ground rules for interviewing multiple State Department officials about the emails, with an eye toward finishing the depositions in the weeks before the party nominating conventions.
Clinton herself may be forced to answer questions under oath, Sullivan said, though she is not yet being forced to take that step.
“Based on information learned during discovery, the deposition of Mrs. Clinton may be necessary,” Sullivan said in an order on Wednesday. [READ THE ORDER BELOW] Discovery is the formal name for the evidence-gathering process, which includes depositions.
“If plaintiff believes Mrs. Clinton’s testimony is required, it will request permission from the Court at the appropriate time.”
In his order, Sullivan pointed to revelations from the emails appearing to show officials trying to evade demands of FOIA.

In one email, for instance, Mull told Abedin that Clinton’s emails “would be subject to FOIA requests” if she used a department-issued BlackBerry, even though her identity would remain secret. Abedin responded that the idea “doesn’t make a whole lot of sense.”

In February, Sullivan ruled that the evidence-gathering process could proceed, and the two sides have been haggling since then.

Sullivan had previously suggested that Clinton could be forced to respond to questions, but his order on Wednesday offered the clearest indication that it remains a real possibility.
The order comes in the course of a lawsuit from conservative watchdog group Judicial Watch, and leaves open the possibility that Clinton will be forced to answer detailed questions on the eve of her formal selection as the Democratic presidential nominee about her creation of the server.
While it is unclear yet if Hillary will be deposed, Sullivan ordered at least six current and former State Department employees to answer questions from Judicial Watch, which has filed multiple lawsuits over the Clinton email case. Among these are longtime Clinton aide Huma Abedin, former chief of staff Cheryl Mills, under secretary for management Patrick Kennedy, former executive secretary Stephen Mull and Bryan Pagliano, the IT official believed to be responsible for setting up and maintaining the server. The judge also ordered the State Department to prepare a formal answer
about Clinton’s emails. Donald Reid, a senior security official, may
also be asked to answer questions, if Judicial Watch so decides.
More importantly, that process is scheduled to be wrapped up within eight weeks, putting the deadline in the final week of June, and well ahead of the presidential election.
* * *
Judicial Watch brought suit against the State Department under the Freedom of Information Act (FOIA) in an effort to bring Abedin’s emails to light. The lawsuit has since evolved into a battleground over Clinton’s use of the private server.
Judicial Watch President Tom Fitton called Wednesday’s order “a significant victory for transparency and accountability,” and promised that it would shine a light on Clinton’s email practices.
“Judicial Watch will use this discovery to get all of the facts behind Hillary Clinton’s and the Obama State Department’s thwarting of FOIA so that the public can be sure that all of the emails from her illicit email system are reviewed and released to the public as the law requires,” he said in a statement.

Any deposition would surely roil the presidential race and force her campaign to confront the issue, which has dogged her for a year. Once again, this is precisely what Trump will pounce on and will be sure to make it the centerpiece of all his upcoming debates with

Bernanke's Former Advisor: "People Would Be Stunned To Know The Extent To Which The Fed Is Privately Owned"

Tyler Durden's picture

http://www.zerohedge.com/news/2016-04-11/bernankes-former-advisor-people-would-be-stunned-know-extent-which-fed-privately-own
With every passing day, the Fed is slowly but surely losing the game.
Only it is not just former (and in some cases current) Fed presidents admitting central banks are increasingly powerless to boost the global economy, even if they still have sway over capital markets. What is far more insidious to the Fed's waning credibility is when former economists affiliated with the Fed start repeating mantras that until recently were only a prominent feature in the so-called fringe media.
This is precisely what happened today when former central bank staffer and Dartmouth College economics professor Andrew Levin, special adviser to then Fed Chairman Ben Bernanke between 2010 to 2012, joined with an activist group to argue for overhauls at the central bank that they say would distance it from Wall Street and make its activities more transparent and accountable to the public.
Levin is pressing for the overhaul with Fed Up coalition activists. Many of the proposed changes target the 12 regional Federal Reserve Banks, which are quasi-private and technically owned by commercial banks in their respective districts.
All of that is not surprising. What he said to justify his new found cause, however, is.
"A lot of people would be stunned to know” the extent to which the Federal Reserve is privately owned, Mr. Levin said. The Fed “should be a fully public institution just like every other central bank” in the developed world, he said in a conference call announcing the plan. He described his proposals as "sensible, pragmatic and nonpartisan."
Why is that stunning? Because it has long been a bone of contention if only among the fringe media, that at its core the Fed is merely a private institution, beholden only to its de facto owners: not the people of the U.S. but to a small cabal of banks. Worse, the actual org chart of who owns what is not disclosed, even as the vast majority of the U.S. population remains deluded that the Fed is a publicly owned institution.
As the WSJ goes on to note, the former central bank staffer said he sees his ideas as designed to maintain the virtues the central bank already brings to the table. They aren’t targeted at changing how policy is conducted today. “What’s important here is that reform to the Federal Reserve can last for 100 years, not just the near term,” he said.
And this is coming from a former Fed employee and Ben Bernanke's personal advisor! That in itself is a most striking development, because now that the insiders are finally speaking up, it will be a race among both current and prior Fed workers to reveal as much dirty laundry as possible ahead of what is increasingly being perceived by many as the Fed's demise.
To be sure, Levin's personal campaign for Fed transformation will not be easy, and as the WSJ writes, what is being sought by Mr. Levin and the activists is significant and would require congressional action. Ady Barkan, who leads the Fed Up campaign, said the Fed’s current structure “is an embarrassment to America” and Fed leaders haven’t been “willing or able” to make changes.
Specifically, Levin wants the 12 regional Fed banks to be brought fully into the government. He also wants the process of selecting new bank presidents—they are key regulators and contributors in setting interest-rate policy—opened up more fully to public input, as well as term limits for Fed officials.
This would represent a revolution to the internal staffing of the Fed, which will no longer be at the mercy of its now-defunct shareholders, America's commercial banks; it would also mean that Goldman Sachs would lose all its leverage as the world's biggest central bank incubator, a revolving door relationship which has allowed the Manhattan firm to dominate the world of finance for the decades.
Levin’s proposal was made in conjunction with the Center for Popular Democracy’s Fed Up coalition, a group that has been pressuring the central bank for more accountability for some time. The left-leaning group has been critical of the structure of the regional banks, and has been pressing the Fed to hold off on raising rates in a bid to make sure the recovery is enjoyed not just by the wealthy, in their view.
The proposal was revealed on a conference call that also included a representative from Bernie Sanders’s presidential campaign, although all campaigns were invited to participate.
The WSJ adds that according to Levin, who knows the Fed's operating structure intimately, says the members of the regional Fed bank boards of directors, the majority of whom are selected by the private banks with the approval of the Washington-based governors, should be chosen differently. The professor says director slots now reserved for financial professionals regulated by the Fed should be eliminated, and that directors who oversee and advise the regional banks should be selected in a public process involving the Washington governors and local elected officials. These directors also should better represent the diversity of the U.S.
Levin also wants formal public input into the selection of new bank presidents, with candidates’ names known publicly and a process that allows for public comment in a way that doesn’t now exist. The professor also wants all Fed officials to serve for single seven-year terms, which would give them the needed distance from the political process while eliminating situations where some policy makers stay at the bank for decades. Alan Greenspan, for example, was Fed chairman from 1987 to 2006.
As the WSJ conveniently adds, the selection of regional bank presidents has become a hot-button issue. Currently, the leaders of the New York, Philadelphia, Dallas and Minneapolis Fed banks are helmed by men who formerly worked for or had close connections to investment bank Goldman Sachs.
Levin called for watchdog agency the Government Accountability Office to annually review and report on Fed operations, including the regional Fed banks. He also wants the regional Fed banks to be covered under the Freedom of Information Act. A regular annual review hopefully would insulate the effort from perceptions of political interference, Mr. Levin said.
* * *
While ending the Fed may still seem like a pipe dream, at least until the market's next major crash at which point the population may  finally turn on the culprit behind America's serial boom-bust culture, the U.S. central bank, Levin's proposal would get to the heart of the most insidious conflict of interest in the US: the fact that the Federal Reserve works not for the people of America, but for its owners - the banks.
Which is also why, sadly, this proposal will be dead on arrival, as its passage would represent the biggest loss for Wall Street in the past 103 years, far more significant than anything Dodd-Frank could hope to accomplish.

Hillary Clinton Caught In Another Lie

Tyler Durden's picture

http://www.zerohedge.com/news/2015-04-01/hillary-clinton-caught-another-lie
Three weeks ago, when Hillary Clinton was scrambling to come up with a credible lie to explain why she was using a personal server for email distribution - one that was not US government property and thus exempt from official FOIA requests - she said during a press conference at the United Nations that the reason was simple: it was simply a matter of "convenience" of carrying just one device.
"when I got to work as secretary of State, I opted for convenience to use my personal email account, which was allowed by the State Department, because I thought it would be easier to carry just one device for my work and for my personal emails instead of two."
As it turns out she lied. Again.
Once again it is the AP that has exposed her in the lie, when it reported yesterday that the news agency had received four emails from a Freedom of Information Act request filed in 2013, with one exchange showing Clinton mistakenly responding to senior aide Huma Abedin’s email about drone strikes with questions about furniture.
“I like the idea of these," Clinton wrote in the email.

"How high are they? What would the bench be made of? And I'd prefer two shelves or attractive boxes/baskets/ conmtainers [sic] on one. What do you think?"

When Abedin emailed back to ask if Clinton had meant to send that to her, the then-secretary of State responded: “No-sorry! Also, pls let me know if you got a reply from my ipad. I'm not sure replies go thru."
They did go through, but a bigger question is why Clinton used not one but two email devices: after all wasn't this "inconvenient"?
Furthermore, while one can always be forgiven (if only once) the traditional email Reply To All blunder, how one can reply about an email discussing drone strikes with what is clearly a home improvement order in process is beyond anyone's imagination. One wonders how many Pottery Barn coupons Bashar Assad got over the past several years courtesy of Hillary.
And then there is the question of why she lied again. Here we get another token explanation which is now merely pandering to the most naive of Clinton fans:
Nick Merrill, a Clinton spokesman, told the AP that she occasionally used her iPad to read news clippings.
In other words, confidential state data and emails were transiting not only an unsafe home server with unknown encryption, but also traversed the very much insecure Apple infrastructure. As in these guys:

Sensing that the scandal is rapidly running out of control, and with every incremental lie Clinton just digs herself into an ever deeper hole, Clinton's paid flacks are doing their best to redirect this scandal and make it seem like a witch hunt.
Adrienne Watson, a spokeswoman for the pro-Clinton rapid response group Correct the Record, blasted the GOP attacks.

“This is an attempt by the right wing to beat to death a manufactured controversy and distract from real issues such as getting good paying jobs to working and middle class Americans," Watson told The Hill.

"Hillary used her iPad as many do, to read news clippings. Republicans should demand a message from their leaders instead of failed attacks.
It sounds like Republicans are demanding an explanation why she can't keep her lies straight. As for the process being a witch hunt, indeed in some ways it just may be.

And now we look forward to the upcoming Congressional kangaroo court in which the American population will be asked "what difference does it make" how many email devices Hillary used.
